1. Personal Data
We, Barnert Egermann Illigasch Rechtsanwälte GmbH, collect, process and use your personal data, in compliance with data protection and civil law provisions, only with your consent and within the scope of our mandate or appointment for the purposes agreed with you, or if another legal basis in accordance with Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, "GDPR") exists.
We only collect personal data which are necessary for the execution and completion of our attorney services or which you made available to us otherwise.
Personal data comprise all data that contain individual information about personal or factual circumstances, such as name, address, e-mail address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of persons and biometric data such as fingerprints. "Sensitive data", such as health data or data in connection with criminal proceedings, may also be comprised.
2. Information and other Data Subject Rights
As a client or data subject in general, you have the right to be informed at any time about your stored personal data, its origin and recipients and the purpose of data processing as well as a right to rectification, data transmission, objection, restriction of processing and blocking or erasure of incorrect or unlawfully processed data. All of this, however, only in compliance with an attorney's legal duty of confidentiality and other legal rights and obligations applicable to us.
Should there be any changes to your personal data, please let us know.
You have the right to withdraw your consent to the use of your personal data at any time. Your request for information, erasure, correction, objection and/or data transmission, in the latter case, provided that this does not cause a disproportionate effort, can be addressed to the address of our law firm stated in clause 10. of this privacy notice.
If you are of the opinion that the processing of your personal data violates applicable data protection laws or that your data protection rights have been violated in any other way, you may complain to the competent supervisory authority. In Austria, this is the Data Protection Authority (Datenschutzbehörde).
3. Data Protection
Your personal data is protected by appropriate organizational and technical measures. These measures concern in particular the protection against unauthorised, illegal or also accidental access, processing, loss, use and manipulation.
Notwithstanding our efforts to maintain a reasonably high level of care, it cannot be excluded that information that you provide to us via the internet may be viewed and used by others.
We therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacking of e-mail accounts or telephone, interception of facsimiles).
4. Use of Data
We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. Excluded from this is the use for statistical purposes, provided that the data provided has been rendered anonymous.
5. Obtaining Data from Third Parties; Transmission of Data to Third Parties
As part of our legal representation and support, we also regularly obtain factual and case-related information from third parties.
In order to fulfil your mandate it may also be necessary to transmit your data to third parties (e.g. counterparties, subcontractors, insurance companies, service providers we use and to whom we make data available, etc), courts or authorities. Your data will only be forwarded in accordance with the GDPR, in particular in order to fulfil your mandate and/or with your prior consent.
Some of the above recipients of your personal data are located outside of Austria or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection, or we take measures to ensure that all recipients have an adequate level of data protection for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).
6. Data Breach Notifications
We will endeavour to ensure that any data breaches are detected at an early stage and, if necessary, reported immediately to you or the responsible supervisory authority, taking into account the respective data categories that are affected.
7. Storage of Data
We will not keep data longer than necessary to fulfil our contractual or legal obligations and to avert any liability claims.
8. Cookies
This website uses "cookies" to make our service more user-friendly, effective and secure.
A "cookie" is a small text file that we transmit via our webserver to the browser's cookie file on your computer's hard drive. This enables our website to recognise you as a user when a connection is established between our webserver and your browser. 9. Server-Log-Files
In order to optimise this website in terms of system performance, user-friendliness and provision of useful information about our services, the provider of the website automatically collects and stores information, which your browser automatically transmits, in so-called server log files. This includes your internet protocol address (IP address), browser and language setting, operating system, referrer URL, your internet service provider and date/time.
These data are not aggregated with personal data sources. We reserve the right to check this data subsequently if we become aware of any concrete indications of illegal use.
