Our Competition Law team has long-standing experience in advising national and international companies on all aspects of EU and Austrian competition law, including cartel investigations, merger control, compliance and distribution matters.
The law firm advises and represents national and international companies before the Austrian competition authorities, civil courts as well as the European Commission and the European Court of Justice. Clients include private sector companies, industry associations, public utilities and other public bodies/authorities.
We provide support in ensuring antitrust compliance: we take care of the design of compliance systems, the preparation of guidelines for various functions/departments, holding of antitrust compliance trainings and courses for employees and management, and the implementation of internal whistle-blower systems. Our antitrust law specialists also assist with distribution law issues, including online commerce and digital platforms.
Furthermore, we assist companies during inspections (dawn raids) and other investigative measures by cartel authorities, such as requests for information. We advise in connection with leniency applications and subsequent proceedings before the Cartel Court. We also represent clients in proceedings concerning the abuse of dominance, both on the side of (allegedly) dominant companies and on the side of complainants, as well as in actions for damages following cartel violations (private enforcement).
In transactions, we ensure reliable and efficient handling of all aspects of merger control law – from the analysis of notification requirements in the relevant jurisdictions, the filing of merger control notifications with the Austrian Federal Competition Authority or, at EU level, the Commission, through to the coordination of merger filings in other jurisdictions.
Our expertise also covers questions of investment control (Foreign Direct Investment) and EU state aid law as well as other topics of EU law.
