Our Employment Law team has vast experience in advising and representing renowned national and international businesses as well executive employees in all areas of employment and labour law.
Our team provides advice in connection with the establishment and termination of employment relationships, employment law matters at the interface with data protection and compliance, as well as legal structuring of company benefits, compensation systems and bonus programmes, both at the company level and group-wide. Furthermore, our lawyers advise on employee mobility strategies, transfers of employees within Austria and cross-border, and on operational changes, in particular in connection with a transfer of business. We have outstanding expertise in company pensions.
Our Employment Law team takes a practice-oriented approach in drafting agreements on highly complex legal issues and provides solutions precisely tailored to our clients' individual requirements. We assist our clients in drafting and negotiating of employment contracts, agreements on variable remuneration schemes and working time models, settlement agreements, plant agreements, and other agreements and declarations, both in the field of individual and collective employment law.
In cooperation with our Dispute Resolution team, our employment lawyers represent both employers and executive employees before Austrian civil courts and administrative authorities as well as before of the European Court of Justice. Our litigation activity includes challenges of termination, legal disputes regarding employees with special protection against dismissal (members of works council, expectant mothers, parents on parental leave, employees with disabilities, etc) as well as representation of our clients in remuneration claims, including company pensions. We represent clients before public authorities regarding, in particular, issues of cross-border assignment of employees, especially in connection with regulations on employee posting and employment of temporary workers.
With their comprehensive expertise, our employment lawyers also advise on labour law aspects of cross-border M&A-transactions, including downsizing, and provide support in legal due diligence processes in cooperation with our M&A team.
