Our Real Estate Law team advises national and international companies, public bodies and private clients on all aspects of real estate law.
Our lawyers provide support in all types of real estate transactions and developer projects. We conduct due diligences on real estate law, draft and negotiate purchase agreements for all types of real estate, including business premises and apartments, we establish residential property ownership, apply for approval from the land traffic authorities and advise on financing aspects. We act as escrow agent for mortgage loans, the incorporation of rights in rem in the land register (ownership, lien, easement/encumbrance, real estate charge, right to build), and for processing of the purchase price within the framework of the Austrian electronic legal trust register (eATHB). We also advise on separations of property sites and their implementation in the land register.
We support our clients not only in the acquisition of real estate, but also in all related legal aspects of project development, such as structural decisions under real estate law, construction law, regional planning and zoning law, and project financing.
Furthermore, we advise on the drafting and termination of rental, lease, loan, and other real estate agreements relating to residential properties and business premises. We also provide legal advice on all types of proceedings before arbitration boards, national courts and administrative authorities.
Our expertise also includes legal advice on the Property Developer Contracts Act (Bauträgervertragsgesetz), the Non-Profit Housing Act (Wohnungsgemeinnützigkeitsgesetz) and other legal matters related to real estate.
In real estate transactions, we do not only provide legal advice, but also take care of an efficient structuring and coordination of the entire real estate project with all stakeholders. We work across practice groups, e.g. regarding real estate due diligence issues in M&A transactions (in cooperation with our M & A practice) and in disputes regarding real estate law (in cooperation with our Dispute Resolution practice).
